Surge Brakes are legal for trailers up to 20,000lbs GVWR.

The Federal Motor Carrier Safety Administration (FMCSA), division of the Department
Of Transportation has amended its’ ban on the use of hydraulic surge brakes on trailers.
Surge brakes are now legal for both private and commercial use.

For trailers up to 12,000 lbs. GVWR or less, the trailer weight can not exceed 1.75 times
the weight of the towing vehicle. Trailers over 12,000 lbs up to 20,000 lbs, the trailer
weight can not exceed 1.25 times the weight of the towing vehicle.

This is a federal regulation change, and may or may not change your local or state law,
and enforcement. Please check your local or state law enforcement office for their
regulations, and interpretations of the federal code.
